| 1893-04-08 | Peninsula Enterprise | [CONTINUATION NOT CAPTURED] ...the said court to understand and be informed that on the 28th day of March, A. D. 1893, a schooner, called the "Joseph P. Boggs," was seized by Capt. A. J. Read, the cap- tain of one of the oyster police boats of the State of Virginia, as forfeited to the Com- monwealth of Virginia, in that the said schooner was found on the 10th day of February, A.D. 1893, by Joseph B. Crockett and others, taking oysters with dredges, and instru- ments other than ordinary oyster tongs, in Tan- gier Sound, in the waters of the Commonwealth of Virginia, within the jurisdiction of said coun- ty, and not from either Johnson's Rock, Thor- oughfare Rock, Fox's Island Rock, or California Rock, to wit, from Woman's Marsh Rock. And the said Attorney for the Commonwealth therefore prays that the said schooner, together with her tackle, apparel, anchors, cables, sails, rig- ging, scrapes, dredges and appurtenances, be condemned as forfeited to the Commonwealth of Virginia, and be sold, and the proceeds of sale disposed of according to law; and that all persons concerned in interest be cited to appear and show cause why the said property should not be condemned and sold to enforce the said forfeiture. And your petitioner will ever pray &c. James H. Fletcher, Jr., Att'y. for Com'th. of Accomack Co., Va. And that, upon the filing of the said Informa- tion as aforesaid, the clerk of the said court issued a warrant directed to the sheriff of said county, commanding him to take the property mentioned in said Information into his possession and hold the same subject to further proceedings in the cause; which warrant has been returned with a report to the clerk thereon, as follows: "By virtue of this warrant I have on this 5th day of April, 1893, taken into my custo- dy, the named schooner, "Joseph P. Boggs," with her tackle, apparel, anchors, sails, rigging, scrapes, dredges, appur- tenances, and hold the same subject to the order of the county court of Accomack county. John H. Wise, Sheriff." "Therefore all persons concerned in interest are hereby cited to appear on the first day of the next term of the said county court of Accomack county, at the court house of the said county, and show cause why the prayer of the Information for condemnation and sale of the property to enforce the said forfeiture and proceeds of sale disposed of according to law should not be granted. Montcalm Oldham, Jr., clerk of the county court, at the court house, the 5th day of April, A. D. 1893, and in the 117th year of the Commonwealth." | ![]() Open high-resolution article image Open captured viewer image Open Newspapers.com viewer (Newspapers.com login required) |
